This leads me to the second part of this blog. While no one would wish such a pandemic on anyone ever again, one thing that comes to my mind about how society and humanity has faced this crisis demonstrates the incredible creativity, ingenuity, and generosity of the human spirit. Businesses have adapted with incredible speed to find some way of keeping the doors open. Scientists are in the process of beginning human trials for potential vaccines, a process that would normally have taken 5 to 10 years in the past. Businesses of all stripes and types have reprocessed their capabilities to produce ventilators, masks, shields, swabs, and everything needed to protect those who have to work with the infected.

I have witnessed kindness never before seen as neighbors taking care of neighbors. I have seen generosity as people reach out to those who are marginalized or threatened due to lack of work, lack of food, or other trauma. I have seen humanity set aside their politics, religion, bigotry, bias, and bitterness in order to help and comfort others. If anything long-lasting comes out of this pandemic, pray God let it be that when mankind faces its greatest challenges, the goodness, mercy, and integrity of our nature shines forth.

Like so many other businesses and other aspects of our society, the Covid-19 pandemic created significant problems for my practice. How do you evaluate an individual when you can’t even be within 6 feet of them? How do you interact with somebody when everything they touch or everything you touch could possibly be contaminated and even fatal? This attack on our society created significant problems and required creative solutions to problems we have never faced before. I will talk about two aspects of what the entire world has been going through. The first is how my practice had to evolve and adapt to the social distancing and state shut down requirements. The second will be thoughts about what this tells us about humankind.

I must start by saying that I am somewhat of a Luddite when it comes to technology. I am smart enough to figure things out eventually but computers and programming languages that do not come naturally to me. However, as they say, desperate times call for desperate measures. With the help of some very intelligent people around me, I figured out how to utilize WebEx in order to meet with my clients. We developed an evaluation protocol that could be done by WebEx meeting. I would do the interview and administer the Rorschach inkblots to the client through the WebEx platform. My administrator then read the paper/pencil testing portion of the evaluation to the client and recorded the client’s response on the test sheet. For the most part, when it worked best, the client could see the response being filled in on the test sheet.

We then had to convince state agencies that this was an alternative method to evaluate their clients. This was not easy since state agencies tend to amend or change policies with the speed of molasses flowing in the middle of winter. However, several courageous administrators from at least three counties understood the remarkably unique nature of our current circumstances and gave permission to perform evaluations in the new manner. Because of this, while the workload was significantly lower than normal, we were able to provide some evaluations to various agencies and courts.

In the meantime, plans were made to reopen our offices in a healthy and appropriate manner as soon as possible. We developed a protocol that, for the most part, kept a safe 6 foot distance between all parties in the office. The client is at one end of the table that has tissue paper laid down. All the testing materials they would need are available within arm’s reach. I then sit at the other end of the table and provide instruction on how to complete the testing protocols. The client is provided one set of Rorschach ink blot cards, while I used a separate set to help determine where and how the clients saw the images that they saw. For IQ testing, several sets of blocks, which have been gathered over the years of test purchases, are utilized. At the end of the evaluation, the set of blocks used by the individual are put into bleach water and another set is provided for the next client.

You may not particularly like the fact that you’re going to share parenting time with the person who betrayed you or hurt you. However, the whole focus of the custody evaluation comes down to what is best for the children and that should be the bottom line for the evaluator and for the court. That may mean that you don’t win this one. It may mean that you have to share your parenting time with the other parent. If you don’t eventually gain full custody, focus on being the best parent you can be with the time you have because this, in the end, is your most important responsibility as a parent to your children.

Be honest about what you say about the other parent. If they’ve got a problem with drugs, tell the examiner you think that the other parent has a problem with drugs. If they are so infatuated with the new girlfriend that they are ignoring the kids, acknowledge those things. However, your job in the custody evaluation is to prove that you are a good enough parent, not that the other parent is a bad parent. If they are as bad as you say they are, that will come through in the evaluation. There’s a difference between being real and honest about the other parent’s issues and trying to make them look really bad. We don’t expect you to ignore any deficits, problems or disagreements you have with the other parent. We do expect you to focus on how you are a good parent rather than spending all your time talking about how bad the other parent is.

Don’t try to be something you’re not, because most of the psychological tests have validity scales; essentially it has ways of determining if you’re trying to be perfect. No one expects you to be a perfect parent. You just need you to be a “good enough” parent. In fact, the psychological community did a lot of research on how to be a perfect parent. The final conclusion from all of the research that was undertaken is that there is no such thing as a perfect parent. Now we refer to “good enough” parenting. Are you good enough as a parent to provide for your child’s emotional, social, economic, and financial needs? If you have depression or have had depression or anxiety in the past, acknowledge this fact and explain how you are dealing with it through either medication, therapy, or combination of the two. Being honest reflects better on your character and the fact that you are acknowledging an issue and dealing with it in an appropriate manner reflects upon your judgment in a positive way

If you’ve had missed visitations for any reason, make sure there’s a document. Make a call to the friend of the court and have them document that you didn’t have a visitation that time. If there are substance abuse issues in the past by the other party, make sure that is noted; document whatever you can because at that point it is he said, and she said between the parties. Whatever document you can provide is better for you, because otherwise it’s your word against the other parties and they are going to say, “No I didn’t refuse him visitation, he just didn’t show up.” So if you are the one that called the friend of the court and said, “I showed up at the meeting place or I showed up to pick up my daughter or my son and the other party didn’t let me have them”, that’s a document. This supports your side.

Over the next five weeks, this column will discuss the important things you need to know about participating in custody evaluation before you make an appointment.

The evaluation begins the moment you contact the psychologist’s office.

Most psychologists work in either independent practices or small group businesses. This means that the evaluating psychologist will have a great deal of contact with the office personnel, especially with the office manager. When you call to make your first appointment, understand that it is very likely that the office manager or the administrative assistant will speak with the psychologist about their perception of you.

If you are flexible, polite, and respectful, this will reflect positively on you. If you are insistent and demanding, that also will get back to the psychologist. For example, if you insist that you have a specific appointment time, this indicates that you are not considerate of others and the constrained schedules most people have to manage. By working with the office manager to minimize the inconvenience to both yourself and the examining psychologist, this would be considered a positive impression since it suggests that you would be capable of working in a mediated manner throughout the rest of the custody process.

While there is some dispute in the research community about the percentage of communication that is non-verbal, it is obvious that body language can provide information that the client may not want you to know. Case in point: When asked about her childhood, a very confident woman said she had a good childhood. However, her demeanor immediately changed. Her shoulders sagged, her breathing became rapid and shallow, her face blushed, and her eyes teared up. All of a sudden she had trouble making eye contact. She eventually admitted that her father had sexually abused her and that when she told her mother about it, her mother blamed her. Never overlook the importance of non-verbal clues such as body language, tone of voice or emotional dissonance between what is being said and how it is being said.
